1. Eligibility & Age Restriction

By registering for an account or using any of our services, you represent and warrant that:

• You have the legal capacity to enter into binding contracts
• You are not located in a jurisdiction where use of AI generation platforms is prohibited
• All information you provide is truthful and accurate

False Age Declaration: Any user found to have falsely declared their age will have their account terminated immediately without refund of any unused credits or subscription fees. We reserve the right to pursue legal action for damages resulting from such false declarations.

2. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Notify us immediately of any unauthorized use of your account
• Not share your API keys or account access with any third party
• Accept full responsibility for all activities that occur under your account

3. AI Services & Content Generation

Our platform provides access to various AI models for generating images, audio, video, text, and other creative content. You acknowledge that:

• AI-generated content may contain errors, biases, or unexpected results
• We do not guarantee the accuracy, quality, or suitability of any AI-generated output
• You are solely responsible for reviewing and validating all AI-generated content before use
• AI models may produce similar outputs for different users
• We may use your inputs to improve our AI models (unless you opt out)

4. Prohibited Uses

You agree NOT to use our platform for:

• ❌ Generating illegal content or materials that violate any applicable laws
• ❌ Creating deepfakes or misleading content without proper disclosure
• ❌ Generating NSFW, explicit, or adult content
• ❌ Producing hate speech, harassment, or content promoting violence
• ❌ Creating content that infringes on intellectual property rights
• ❌ Reverse engineering, decompiling, or attempting to extract source code
• ❌ Using automated scripts or bots to abuse our API or services
• ❌ Generating medical, legal, or financial advice
• ❌ Impersonating any person or entity

Violation of these prohibitions will result in immediate account termination and may be reported to relevant authorities.

5. Intellectual Property & Ownership

5.1 Your Content

You retain ownership of any content you input into our platform ("Input"). For AI-generated outputs ("Output"):

• You own the Output created using your paid account
• We grant you a worldwide, perpetual, royalty-free license to use the Output
• We may use anonymized Output for quality improvement and model training

5.2 Our Platform

All intellectual property rights in our platform, software, trademarks, and logos remain the exclusive property of AiCreator5. You may not:

• Copy, modify, or create derivative works of our platform
• Remove any copyright or proprietary notices
• Use our trademarks without prior written consent

6. Payments, Credits & Refunds

• Credits: All credits purchased are non-refundable and expire 12 months from purchase date
• Subscriptions: Monthly subscriptions auto-renew unless cancelled at least 24 hours before renewal
• Refunds: We do not offer refunds for unused credits, failed generations, or user errors
• Chargebacks: Initiating a chargeback will result in immediate account suspension and debt collection
• Price Changes: We reserve the right to modify prices with 30 days notice

7. User Responsibility & Indemnification

YOU BEAR FULL RESPONSIBILITY FOR YOUR USE OF OUR PLATFORM.

You agree to indemnify, defend, and hold harmless AiCreator5, its affiliates, officers, and employees from any claims, damages, losses, or expenses arising from:

• Your use of AI-generated content
• Violation of these Terms
• Infringement of third-party rights
• Your violation of any applicable laws

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• AiCreator5 SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages
• Our TOTAL LIABILITY shall not exceed the amount you paid us in the preceding 12 months
• We are NOT RESPONSIBLE for any damages arising from your use of AI-generated content

10. Termination

We reserve the right to suspend or terminate your account at our sole discretion, including but not limited to:

• Violation of these Terms
• False age declaration
• Abuse of our AI services
• Non-payment or chargebacks
• Extended periods of inactivity (12+ months)

11. Governing Law & Dispute Resolution

• Governing Law: These Terms shall be governed by the laws of [Your Country/State]
• Dispute Resolution: Any disputes shall first be attempted to be resolved through binding arbitration
• Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to class arbitration

• Dashboard notification
• Platform announcement

Continued use of the platform after changes constitutes acceptance of modified Terms.
